KICKOMI Ambassadors Programme Terms
TERMS AND CONDITIONS
The “KICKOMI Ambassadors” Programme
Effective from 20 October 2026
§1. General provisions
1. These Terms set out the rules for participating in the Kickomi brand ambassador programme (the “Programme”).
2. The Programme is organised by Katarzyna Lizurej, running a sole proprietorship under the business name Katarzyna Lizurej, ul. Stanisławowska 47, 54-611 Wrocław, NIP 8993009475, REGON 540210848, e-mail: contact@kickomi.com (the “Organiser”).
3. The purpose of the Programme is to promote the Kickomi brand and the kickomi.com online store through authentic social media content.
4. Participation in the Programme is voluntary and based on barter: the Ambassador receives products in exchange for publishing promotional content.
5. Participation in the Programme begins once the Organiser accepts the application and the applicant (the “Ambassador”) accepts these Terms. The Organiser selects Ambassadors at its sole discretion and is not required to give reasons for a refusal.
§2. Duration of the collaboration
1. The collaboration begins with a 3-month trial period, counted from the day the first PR package is sent.
2. After the trial period, the Organiser may offer to extend the collaboration on the same or amended terms, or may decide not to extend it.
3. The Ambassador may end their participation in the Programme at any time by notifying the Organiser by e-mail. If the Ambassador has already received a PR package, they shall publish the content required for that package.
§3. Age of participants
1. The Programme is open to adults.
2. Persons aged 16 or over but under 18 may participate in the Programme after providing the Organiser with the written consent of a parent or legal guardian (Appendix 1).
3. Persons under 16 may not participate in the Programme.
4. The Organiser may ask for confirmation of age or parental consent before sending a PR package. Without the required consent, the Organiser may refuse participation in the Programme or end the collaboration with immediate effect.
§4. PR packages
1. The Ambassador receives no more than one PR package per month.
2. The contents of each package are selected individually by the Organiser, taking into account, among other things, the Ambassador’s style and engagement and the quality of their content to date. The Organiser does not guarantee any minimum package value.
3. The value of the products is determined by the gross retail price in the kickomi.com store on the day the package is sent.
4. Ownership of the products passes to the Ambassador upon delivery.
§5. Ambassador’s obligations
1. In return for each PR package, the Ambassador publishes on their Instagram or TikTok profile:
– within 14 days of receiving the package: 1 short video (Reel or TikTok) and 2–3 stories, e.g. an unboxing,
– within 30 days of receiving the package: another short video and 2–3 stories, e.g. styling, interiors, everyday use of the products.
2. Publications should feature Kickomi products or the Kickomi brand, match the brand’s aesthetic and encourage viewers to visit the kickomi.com store.
3. Showing Kickomi products naturally in other publications as well is welcome but not mandatory.
§6. Disclosing the collaboration
1. Every publication made under the Programme must include: a tag of the Kickomi profile (@kickomi_com or another profile indicated by the Organiser), the hashtag indicated by the Organiser, and a clear disclosure of the collaboration in line with the recommendations of UOKiK (the Polish Office of Competition and Consumer Protection), e.g. “barter collaboration with @kickomi_com”, “ad”, or the platform’s paid partnership / sponsored content label.
2. Concealing the collaboration (covert advertising) is prohibited, including suggesting that the products were bought by the Ambassador themselves.
§7. Availability of publications
1. Videos and posts remain publicly available for at least 60 days from publication.
2. Stories remain available for the standard 24 hours.
§8. Content rights
1. The Ambassador grants the Organiser a free, non-exclusive licence to share the published content on Kickomi’s social media profiles by way of sharing or reposting, without modification.
2. Using the content in paid advertising, on the kickomi.com website, in printed materials or in modified form requires the Ambassador’s separate consent.
3. The Ambassador represents that they hold the rights to the published content and that it does not infringe the rights of third parties, including other people’s image rights.
§9. Failure to perform obligations
1. If the Ambassador does not publish the content required for a given package, they will not receive another package, and the Organiser may end the collaboration.
2. The Organiser may ask for collaboration disclosures or content that does not comply with these Terms to be corrected.
§10. Taxes
1. Products received under the Programme may constitute taxable income of the Ambassador.
2. Where required by law, the Organiser will prepare and provide the Ambassador with a tax information form (e.g. PIT-11). For this purpose, the Ambassador shall provide the necessary details.
§11. Nature of the collaboration
1. Participation in the Programme is a barter collaboration based on these Terms (a civil-law agreement). It is neither an employment relationship nor a contract for services with monetary remuneration.
2. The Ambassador acts independently and does not need to run a business.
§12. Termination of the collaboration by the Organiser
The Organiser may end the collaboration in particular in the event of: a breach of these Terms, including the rules on disclosing the collaboration; publication of content that is unlawful or harmful to the image of the Kickomi brand; inactivity for 2 months.
§13. Personal data
1. The controller of the personal data of applicants and Ambassadors is the Organiser.
2. The data provided in the application (including first and last name, contact details, city, date of birth, social media profiles and, in the case of minors, the contact details of a parent or guardian) are processed in order to review the application and carry out the collaboration (Art. 6(1)(b) GDPR), to fulfil tax obligations (Art. 6(1)(c) GDPR) and to defend against any claims (Art. 6(1)(f) GDPR).
3. The data of applicants whose applications were not accepted are deleted no later than 6 months after the application. Ambassadors’ data are stored for the duration of the collaboration and thereafter for the period required by tax law and the limitation period for claims.
4. Further information, including on the rights of data subjects, can be found in the Privacy Policy.
§14. Final provisions
1. The Organiser may amend these Terms for important reasons (e.g. changes in the law or in the Programme rules) by notifying Ambassadors by e-mail at least 14 days in advance. An Ambassador who does not accept the changes may end their participation in the Programme.
2. The Organiser may end the Programme by notifying Ambassadors by e-mail.
