KICKOMI Art Lab Programme Terms
TERMS AND CONDITIONS
The “KICKOMI Art Lab” Programme
Effective from 20 October 2026
§1. General provisions
1. These Terms set out the rules for participating in the “KICKOMI Art Lab” programme (the “Programme”). The Programme is organised by Katarzyna Lizurej, running a sole proprietorship under the business name Katarzyna Lizurej, ul. Stanisławowska 47, 54-611 Wrocław, NIP 8993009475, REGON 540210848, e-mail: contact@kickomi.com (the “Organiser”).
2. The Programme is aimed at visual artists (including in painting, illustration, graphic art, sculpture, digital art, street art and mixed media) who wish to collaborate with the Kickomi brand (the “Artist”).
3. The Programme comprises three collaboration paths:
a) “Create something for Kickomi” – creating a work commissioned by the Organiser (e.g. graphics, illustrations, packaging, a limited edition);
b) “Sell your work” – selling finished works to the Organiser (e.g. originals, prints, sculptures);
c) “Let’s come up with something together” – joint projects (e.g. collections, installations, events, limited series).
4. Applying to the Programme is voluntary and free of charge.
§2. Who may apply
1. Anyone aged 16 or over who has a portfolio or profile showcasing their work may apply.
2. Applicants under 18 must provide the e-mail address of a parent or legal guardian in their application. Before the collaboration begins, the Organiser will ask for the written consent of the parent or guardian (Appendix 1), and agreements on behalf of the minor will be concluded or approved by their statutory representative.
3. The Organiser selects the persons it will collaborate with at its sole discretion and is not required to give reasons for a refusal.
§3. Application
1. Applications are submitted via the form at kickomi.com/pages/artysci-tworcy. The form includes, among other things: first and last name or pseudonym, e-mail address, city, date of birth, portfolio link, the chosen path and a short description of the applicant’s work.
2. The Organiser reviews applications on an ongoing basis and contacts selected applicants by e-mail.
3. Submitting an application does not constitute the conclusion of an agreement and does not bind either party.
§4. Collaboration rules
1. Each project is carried out under a separate agreement concluded in written or electronic form before work begins. The agreement specifies in particular: the scope of work, deadline, fee, settlement method and the terms of use of the work.
2. “Create something for Kickomi” path: the fee is payable after the final version of the work is accepted, within 14 days, on the basis of an invoice or bill, unless the agreement provides otherwise. The Organiser may request revisions within the scope set out in the agreement.
3. “Sell your work” path: the Organiser is under no obligation to purchase any work. If interested, it will present a price offer. Purchasing a copy of a work (e.g. a painting, sculpture or print) does not mean a transfer of the author’s economic rights – under Art. 52 of the Polish Act on Copyright and Related Rights (ustawa o prawie autorskim i prawach pokrewnych), this requires a separate, express agreement.
4. “Let’s come up with something together” path: before the project begins, the parties agree on the scope, division of tasks, fee, schedule and copyright rules.
§5. Copyright
1. The Artist represents that they are the author of the works submitted and created, that they hold the copyright to them and that the works do not infringe the rights of third parties.
2. A transfer of the author’s economic rights or the grant of an exclusive licence requires an agreement in written form and covers only the fields of exploitation expressly listed therein. A non-exclusive licence may be granted in documentary form, specifying the fields of exploitation.
3. The Artist retains their moral rights, including the right to have the work credited with their name or pseudonym. The Organiser credits authorship in all publications concerning the work, unless the Artist decides otherwise.
4. The Organiser does not modify the work without the Artist’s consent, unless the agreement provides otherwise.
§6. Fees
1. The fee is agreed individually for each project, before it begins, and depends on the scope of work, the collaboration path and the complexity of the project.
2. The cost of materials and tools is borne by the Artist, unless the parties agree otherwise.
3. Where required by law, the Organiser withholds tax advance payments and provides the Artist with a tax information form (e.g. PIT-11).
§7. Additional benefits
As part of the Programme, the Artist may receive, among other things: credit for authorship on the project, visibility in Kickomi’s channels (social media, website, events), access to Kickomi products and drops, and the opportunity to take part in further, larger projects.
§8. Withdrawal and termination of the collaboration
1. The Artist may withdraw from the Programme at any time by notifying the Organiser by e-mail. Withdrawal does not affect agreements concluded earlier.
2. The Organiser may end the collaboration under the Programme in particular in the event of: a breach of these Terms, infringement of third-party rights, acting to the detriment of the Kickomi brand or publishing unlawful content.
§9. Nature of the Programme
Participation in the Programme is not an employment relationship. The Artist acts independently and does not need to run a business. Rights and obligations relating to specific projects arise from the agreements referred to in §4.
§10. Personal data
1. The controller of the personal data of applicants and Artists is the Organiser.
2. The data provided in the application (including first and last name or pseudonym, contact details, city, date of birth, links to portfolio and profiles and, in the case of minors, the contact details of a parent or guardian) are processed in order to review the application and enter into collaboration (Art. 6(1)(b) GDPR), to perform agreements (Art. 6(1)(b) GDPR), to fulfil tax and accounting obligations (Art. 6(1)(c) GDPR), to credit authorship and promote projects (Art. 6(1)(f) GDPR) and to defend against any claims (Art. 6(1)(f) GDPR).
3. The data of persons with whom no collaboration was entered into are deleted no later than 6 months after the application. Artists’ data are stored for the duration of the collaboration and thereafter for the period required by tax law and the limitation period for claims.
4. Further information, including on the rights of data subjects and the right to lodge a complaint with the President of UODO (the Polish Personal Data Protection Office), can be found in the Privacy Policy.
§11. Final provisions
1. The Organiser may amend these Terms for important reasons (e.g. changes in the law or in the Programme rules) by notifying Artists by e-mail at least 14 days in advance. The changes do not apply to agreements concluded earlier.
2. Questions about the Programme can be sent to contact@kickomi.com.
3. Matters not regulated herein are governed by Polish law, in particular the Polish Civil Code (Kodeks cywilny) and the Act on Copyright and Related Rights (ustawa o prawie autorskim i prawach pokrewnych). The parties will seek to resolve disputes amicably.
